Recurso de Súplica contra el auto del 18 de julio de 2011, proferido por el magistrado Luis Ernesto Vargas Silva dentro de la demanda de la referencia.
El auto de rechazo estuvo fundamentado en la verificación del vencimiento del término de caducidad de la acción pública de inconstitucionalidad y la Sala reitera que todas las acciones públicas de inconstitucionalidad contra actos que pretenden reformar la Constitución, caducan en el término de un año contado a partir de la promulgación del acto cuestionado.
En tal sentido se resuelve CONFIRMAR el auto atacado.
